A client’s son moved to Dubai for work, leaving his mother back home in Pune managing the household alone. She was used to handling the family’s day-to-day banking, but every time she needed to access money he sent, or manage a joint expense, the two of them ran into confusion about whose account this even was, and what either of them was legally allowed to do with it.

This confusion is common, and it usually comes down to one thing: people conflate several different account structures that sound similar but follow very different rules.

Yes, an NRI can hold a joint account with a resident Indian close relative, but the exact rules depend on whose account it is. If a resident relative joins the NRI’s NRO account, it must operate on a “former or survivor” basis, with the resident as the second holder. Can an NRI Open a Joint Account With a Resident Indian?

Yes, but the rules changed significantly after 2011, when the RBI first allowed NRIs to be added as joint holders on a resident’s savings account. Before that, this simply was not possible. Since then, two distinct structures exist, and mixing them up is where most confusion comes from.

Structure 1: An NRI is added as a joint holder to a resident’s own savings account. For example, a son working abroad joins his mother’s existing resident savings account. This account operates on an “either or survivor” basis, meaning either the resident or the NRI can independently operate the account. The resident remains the primary or first holder, and the account continues to follow all rules applicable to a normal resident savings account.

Structure 2: A resident relative is added as a joint holder to the NRI’s own NRO account. This is the reverse direction, and it follows a stricter rule: it must operate on a “former or survivor” basis, meaning the NRI remains the primary account operator, and the resident relative can only step in and operate the account if the NRI is unavailable or has passed away, not concurrently at will.

Who Qualifies as a Close Relative

Not just anyone can be added as a joint holder. The relative must fall within the definition used under the Companies Act, which for these purposes generally covers parents, siblings, siblings’ spouses, one’s own spouse, children, spouses of children, grandparents, grandchildren, and spouses of grandchildren. A friend or a distant relative does not qualify, no matter how much trust exists between the two parties.

Key Conditions That Apply

  • The bank must maintain proper documentation, record the business rationale for the account, and obtain a signed declaration from the NRI confirming they will not use the account in violation of FEMA, and that they bear responsibility for any violation that does occur.
  • When an NRI is added to a resident’s savings account, the NRI cannot deposit cash, cheques, direct credits, or remittances into that account. This account is meant to facilitate the resident’s own transactions in India, not to serve as a channel for the NRI’s foreign earnings.
  • Funds in this account cannot be transferred outside India, given as a gift, or moved into the NRI’s own NRE or NRO accounts.
  • If circumstances change and the NRI becomes the sole surviving holder, the account is automatically re-categorised as an NRO account, since an NRI cannot continue holding a resident account solely in their own name.

Can an NRI Hold a Resident Savings Account as the Sole Holder?

No. Once your status changes to NRI, you are required to inform your bank and either close your existing resident savings account or convert it. Continuing to operate a resident savings account solely in your own name as an NRI is a FEMA violation and carries a penalty. This is one of the most common compliance gaps we see, particularly among NRIs who moved abroad gradually and never got around to formally updating their account status.

Once your status changes, the accounts available to you are the Non-Resident Rupee account (NRE), the Foreign Currency Non-Resident account (FCNR), the Non-Resident Ordinary Rupee account (NRO), and for business purposes, the Special Non-Resident Rupee account (SNRR). Alongside these, you can still be added as a joint holder on a close relative’s resident savings account under the either-or-survivor structure described above.

How to Convert a Resident Account to an NRO Account

Step 1: Inform your bank that your residential status is changing.

Step 2: Obtain and complete the conversion form for redesignating a resident account to an NRO account.

Step 3: Prepare the required documentation, including KYC, visa or work permit, and passport copies.

Step 4: Submit all documentation to your bank.

Step 5: The bank verifies the details and, once approved, redesignates the account from resident status to NRO status.

How to Convert an NRI Account Back to a Resident Account

When you are returning to India and becoming a resident again, you file a declaration with your bank stating this change, and request that your NRO account be re-designated as a resident savings account. This should be submitted directly to your local branch.

Can an NRO joint account with a resident operate on an either-or-survivor basis?

No. When a resident relative is added as a joint holder to an NRI’s NRO account, it must operate on a former-or-survivor basis, meaning the resident can only step in if the NRI is unavailable, not concurrently at will. This is different from an NRI being added to a resident’s own savings account, which can operate on an either-or-survivor basis.

Can an NRI open or hold a resident savings account as the sole holder?

No. Once your status changes to NRI, holding a resident savings account solely in your own name is a violation of FEMA and carries a penalty. You must either close the account or convert it to an NRO account, or continue holding it jointly with a resident close relative under the either-or-survivor structure.

  • I have been NRI for the past 20 years. in this period, my father and wife also were with me in Foreign. They both had their individual earning here. However, for the sake of convivence, we had one bank account in my name and all such balances were transferred to India and most of them maintained as FDR.       Whether salary directly received in an Indian bank account by an NRI for receives rendered outside India has been a matter of frequent litigation. In these cases, usually, the view has been that such salary is not taxable in India since the services have not been rendered in India, and funds have been merely remitted to an Indian bank account. However, in some cases, such income is taxed in India based upon the fact that it was first received in India. It is recommended that you receive the salary locally where you are employed and then remit it as required by you. Otherwise, you may have to report it in tax returns in both the countries and take credit of taxes paid in the country where you are resident for tax paid outside based upon double tax avoidance agreement between the two countries.

      Yes, you can redesignate your joint saving account to NRO account if your wife status is NRI as NRO account allows joint holding with a resident relative. Regarding KYC its better you should check bank website.

      As per law, NRE account cannot be held jointly by NRI and resident relative.You have to intimate your bank regarding your wife status

      Only 2 NRIs can become joint holders of NRE Account. You three cant be joint holders of NRE account

      Definitely online money transfers such as western money transfers are faster and cheaper mode of transferring money abroad.As per RBI guideline, there is a per person per year limit of $250000 or its equivalent in indian rupees on transfers.
